Clubhouse User Agreement

 

HIGHLANDS OF LEAWOOD CLUBHOUSE USER AGREEMENT 

(Effective November 1, 1998; Revised: September 15, 2009; Revised: February 18, 2025; Revised: January 9, 2026) 

 

THE POOL CAN NOT BE RENTED FOR PRIVATE PARTIES. IF OUR POOL  MANAGER IS GETTING THE POOL READY FOR OPENING DAY, THE DECK CAN  NOT BE USED. OUTSIDE BATHROOMS CAN NOT BE USED UNTIL MEMORIAL DAY. ON GUEST RESTRICTED HOLIDAYS ONLY FOUR GUESTS CAN USE THE  POOL REGARDLESS OF CLUBHOUSE RENTAL. THIS RENTAL AGREEMENT AND  THE MONIES COLLECTED FOR CLEANING DO NOT PERTAIN TO POOL USAGE  BUT ARE FOR THE SOLE PURPOSE OF CLUBHOUSE CLEANING AND SUPPLIES.

This agreement is made and entered into this ____________day of _________,  20______.  BY AND BETWEEN Highlands of Leawood Homes Association of  Leawood, a not-for-profit corporation organized and existing under the laws  of the State of Kansas, hereinafter “HLHA” and _______________________________ of______________________  Leawood, Kansas, a resident of Highlands of Leawood subdivision in said city,  hereinafter “USER”, 

WITNESSETH: that the user shall reserve from HLHA the Highlands of Leawood  Clubhouse, hereinafter “the facility,” for a __________________________ (type of  function) upon the following terms and conditions: 

1. The function will be held on _____________________, 20____, from ______  until _______. Bands, disc jockeys, and outside music are prohibited after 9:00 p.m. The pool and pool deck areas will close at 9:00 p.m. 

2. The number of persons attending the function shall be ________adults and/or ________ children under the age of 18. THE CAPACITY OF THE CLUBHOUSE IS 40 PEOPLE, AS ISSUED BY THE CITY OF LEAWOOD FIRE MARSHAL. 

3. If alcoholic beverages are to be served, they will be served with all respects in compliance with the Kansas State and Leawood City laws (to no one under 21 years of age) and an I.D. MUST be checked. 

 

4. The user paid a deposit of $50.00 at the time of application, which HLHA has acknowledged. The User agrees to keep the reserved facility and grounds clean before leaving. HLHA, through its Clubhouse Committee or Board of Directors, reserves the right to determine whether the user has complied with these conditions and is entitled to a $25.00 refund.

5. RESIDENT(S) MUST BE PRESENT AT ALL TIMES DURING THE  FUNCTION!! The User agrees to accept full responsibility for all actions of his/her guests using the facility and agrees that the facility shall not be used for unlawful purposes. The Leawood Police, Fire,  and Building Inspection Departments, any member of the Clubhouse  Committee, and any member of the Board of Directors are given the express right to enter the facility during any private party. If any of the above finds the facility is crowded beyond capacity or activities therein violate any Kansas, Leawood, or Homes Association law,  ordinance, rule, or agreement, or is destructive of Homes  Association property, the event shall be ended immediately, and all persons shall be required to leave the premises and grounds. 

6. The user is responsible for completing items on the cleaning checklist before leaving.

7. When the pool is open for the season, trash is left in outdoor garbage cans. Garbage/leftover food items must be placed in a  plastic bag and securely tied before being put into the outdoor  garbage cans.) At all other times, trash must be taken home with the user.

8. The User agrees to pay any damages to and/or costs resulting from damage to the premises and equipment. The User acknowledges that his/her liability shall NOT be limited to the deposit amount noted above. 

9. Pool and clubhouse furniture should be put back in place. The fridge cannot be moved. 

10. Open flames are not allowed on the pool deck or in the clubhouse.  Only battery-operated candles are permitted, and lighting the fireplace is not allowed. 

11. No smoking in the clubhouse. 

12. BOUNCE HOUSES ARE NOT PERMITTED ON HOA PROPERTY, EITHER BY THE CLUBHOUSE OR ANY COMMON AREA. 

13. The deposit will not be refunded if the resident/user and their  guests do not comply with the terms of this agreement or if the  Leawood Police are called to break up a private function. 

14. Any deposit will be returned to you within ten business days. 

The user agrees to hold harmless the following: Highlands of Leawood Homes  Association of Leawood, Inc., its Board of Directors, employees, and agents thereof for any act, omission, or error which may occur because of the use of the. Directors, employees, and agents thereof for any act, omission, or error that may occur because of the use of the clubhouse, adjacent walkways, or parking lot.

 CLUBHOUSE CLEANING CHECKLIST:

Return interior and pool deck furniture to their original places.

Vacuum carpet, hardwood floors, and bathroom (the vacuum is  either in the closet or the basement)

Clean the hardwood floor. A swifter is located near the vacuum.

Clean the bathroom and toilet! Bar area and fridge: dispose of all food and ice!

Empty the garbage can and wipe it down.

During winter, set the thermostat to 55; during summer, set it to 85.

Turn off all lights EXCEPT the front porch lights.

Put the trash in the outside dumpster, and during pool season, place all leftover food in a sealed, tied plastic bag.  Out of season, take trash home. DO NOT LEAVE ICE IN THE FRIDGE!
